I. Parties
These General Terms and Conditions of Sale are entered into between, on the one hand, IZOM Athlétique, a SASU with capital of €26,000 registered with the Créteil Trade and Companies Register on 02/10/2023 under number 980 423 545, having its registered office at 8, place Salvador Allende 94000 Créteil (hereinafter referred to as “IZOM Athlétique”), and, on the other hand, any person having made a purchase on the www.izom-athletique.com website, hereinafter referred to as “the Customer”. Any purchase from the www.izom-athletique.com website (hereinafter referred to as the “Site”) automatically implies acceptance of these terms and conditions in their entirety.

II. Definitions
Customer: refers to any individual or legal entity, under private or public law, who purchases a product through the Site and/or who has a personal account on the Site.

Order: refers to the process whereby the customer selects the products they wish to purchase and have them delivered. An order is finalized when the Customer has selected the products he/she wishes to order and the delivery options, and when he/she has paid the total amount due using the dedicated payment system. Once the order has been finalized, IZOM Athlétique will ship the products ordered in accordance with the terms and conditions and within the timeframe specified in these GTC

Site content: elements of any kind published on the site, whether or not protected by intellectual property rights, such as texts, images, designs, presentations, videos, diagrams, structures, databases or software.

Personal data: refers to all personal information relating to the customer as an individual and entered by him/her when registering on the site or placing an order. All information relating to the rights of access, rectification and deletion of such data is available on the “Personal data” page.

Publisher: IZOM Athlétique, SASU in its capacity as publisher of the Site.

Parties: refers jointly to IZOM Athlétique and the Users of the Site.

Product: refers to the available products offered for sale on the Site by the Seller, IZOM Athlétique, to its customers.

Site: Internet site accessible at the URL www.izom-athletique.com, as well as sub-sites, mirror sites, portals and variations of URLs relating thereto.

User: refers to any individual or legal entity, private or public, accessing the Site, whether or not they are a Customer.

III. Purpose of the GCS and current version / Scope
The purpose of these GCS is to define the conditions under which users may access the Site, place orders and manage the relationship between IZOM Athlétique and users, including all rights and obligations arising therefrom.

They apply to relations between users and IZOM Athlétique. The Site is freely accessible to all users. Any person wishing to place an order undertakes to comply, without restriction or reservation, with these GTC, whether visiting the Site or placing an order. The GTC are notified to users for acceptance prior to any order on the Site.

IZOM Athlétique is free to modify these GTC at any time and without prior notice, in particular in order to take into account any legal, jurisprudential and/or technical developments. IZOM Athlétique will inform the user by any means, who may cancel his subscription within thirty (30) days in the event of disagreement at the following address: 8 place Salvador Allende 94000 Créteil.

In any event, the fact that the User continues to use the site after being informed of the modification of the GCS implies acceptance of the modifications by the User.

The prevailing version of the GCS is the latest version available on the Site.

The version applicable to an order is the one in force on the date the order is placed.

Each new order requires acceptance of the GCS by the customer, which the latter acknowledges and accepts by ticking a box.

When registering on the site, acceptance of the GCS will be confirmed by ticking the corresponding box.

The user declares that he has obtained from IZOM Athlétique, prior to his order, all the information on the products and delivery terms. The user declares that he/she is solely responsible for the choice of Products and their suitability for his/her needs.

The user must be a duly represented legal entity or a natural person of legal age to place an order on the Site. Failing this, he/she must have the authorization of his/her legal representative to place an order, which he/she expressly acknowledges and accepts.

IV. Purpose of
The purpose of the Site is to sell Products to Customers.

V. Products
4.1. Description of items

The Products offered for sale are those shown on the Site on the day the Customer consults it, subject to availability.

The Products comply with the legal and regulatory provisions in force at the time they are placed on the market. They are designed in a French laboratory that complies with the ISO 22716 standard relating to good manufacturing practice (GMP), which ensures strict hygiene and safety instructions, and complies with all measures of good laboratory practice (GLP) in order to guarantee the quality and integrity of the products.

The Customer will find on the Site a description of each Product in order to know its essential characteristics within the meaning of article L. 111-1 of the French Consumer Code.

4.2. Presentation of items

The User is informed that photographs of the products appear on the site, which he may consult freely.

IZOM Athlétique makes every effort to ensure that the photographs of the products are as close as possible to the products actually delivered to the customer (in particular the color of the products). Nevertheless, IZOM Athlétique cannot guarantee that the products will be exactly identical to the photographs, in particular due to the technical constraints of making photographs available on the Site.

Furthermore, IZOM Athlétique strives to present and describe its products as accurately as possible. Nevertheless, subject to providing a faithful presentation of the essential qualities of its products, IZOM Athlétique cannot guarantee exhaustive communication of all the characteristics of each Product. Should the User wish to receive further information about a Product, he/she is invited to contact customer service at the following address: contact@izomathletique.com.

The User declares that he/she is fully aware of the provisions of this article, and hereby expressly agrees not to hold IZOM Athlétique liable in this respect, subject to the application of mandatory legal provisions (in particular the guarantee of conformity).

4.3. Product availability

Product offers and prices are subject to availability.

In the event of unavailability of the product ordered, IZOM Athlétique may inform the customer requesting the restocking by e-mail to the address provided or by telephone to the number provided, and may also offer the customer a product of equivalent quality and price.

If the payment has already been debited, IZOM Athlétique will refund the sums paid within a maximum of thirty (30) days from the date of receipt of the refund request or may offer a credit note or an equivalent product.

4.4 Pre-order campaign

Certain products are available for pre-order.

The Customer is informed that production of the Product(s) offered for pre-order has not begun or is in progress at the time of the pre-order.

If the pre-ordered Product(s) cannot be delivered within the agreed delivery time, the Customer will be notified by e-mail. The customer may request that IZOM Athlétique cancel the order. IZOM Athlétique will then cancel the pre-order and reimburse the full amount, including costs, within a maximum of thirty (30) working days.


VI. Price & payment
6.1. Sale price

In accordance with article L. 112-1 of the French Consumer Code, all applicable prices are those displayed on the site on the day the order is placed and are not effective for the future. All prices shown on the www.izom-athletique.com website are in euros (€) and include all taxes (TTC), but exclude delivery charges, customs duties and other taxes.

The amount of delivery charges may vary according to delivery method, weight, size or delivery address, and is mentioned before the order is confirmed, as well as in the Appendix to these GTC. To obtain an estimate, the Customer may simulate his purchases on the Site. This indication remains an estimate and only the price selected at the time of validation of the basket has contractual value, barring exceptions such as delivery difficulties or special delivery methods that may result in additional costs.

IZOM Athlétique reserves the right to modify its prices without prior notice. Prices include value-added tax (VAT) applicable in metropolitan France or in the country of delivery located in the European Union on the day the order is placed.

In the case of orders to countries outside the European Union, the Customer is the importer of the Product(s) concerned. Customs duties or other taxes (local VAT, customs tax, import duties, etc.) may be required. These duties are payable by the Customer.

This indication remains an estimate and only the price retained at the time of validation and are the sole responsibility of the Customer, both in terms of declarations and payment to the competent authorities. IZOM Athlétique recommends that the Customer contact the local authorities for information on these aspects.

6.2. Gift vouchers and promotional codes

Vouchers sent by IZOM Athlétique can be used for 1 year on all products offered on the site. Vouchers are non-transferable but cumulative and cannot be combined with promotional codes. The customer can benefit from the vouchers by entering the reference in the purchase form.

Promotional codes apply only to non-rebated base prices and are valid for the period indicated by IZOM Athlétique. Promotional codes are non-transferable and cannot be combined with each other or with vouchers. Promotional codes can be used 1 time per customer account unless otherwise instructed by IZOM Athlétique. These codes are not refundable in the event of an exchange. The customer can benefit from promotional codes by entering the reference in the purchase form.

6.3. Terms of payment

The price due by the customer is the final amount indicated on the order summary, including postage and other taxes.

Payment is to be made with the order by credit card (Carte Bleue, VISA, Mastercard, American Express) or Apple Pay, Paypal, Stripe.

Online payment by credit card is made via the secure payment system provided by STRIPE, whose General Terms and Conditions are available here. This system is secured using the 3D SECURE encryption protocol. Confidential data (16-digit credit card number, expiry date and CVV code) is encrypted and transmitted directly to the company's server. When paying by credit card, IZOM Athlétique has no access to any data relating to the Customer's means of payment. Payment is made directly to the bank.

The credit card is debited when the order is placed.

At no time do the Customer's bank details pass through IZOM Athlétique's computer system. IZOM Athlétique does not store any of the Customer's bank details.

6.3. Invoicing

An invoice will automatically be sent to the Customer after each order. This invoice will be sent to the e-mail address indicated by the Customer at the time of ordering, unless otherwise specified by the Customer. The Customer expressly agrees to receive invoices electronically.

6.4. Default of payment

Agreed payment dates may not be delayed for any reason whatsoever, including in the event of a dispute.

Any sum not paid on the due date will give rise, ipso jure and without formal notice, to the application of late payment penalties calculated on the basis of a rate equal to 3 times the legal interest rate, without this penalty affecting the due date of the sums due in principal.

In addition, any delay in payment will result in the invoicing to the defaulting Customer of collection costs amounting to 40 euros, the immediate payment of all sums remaining due whatever the agreed deadlines, increased by an indemnity of 20% of the amount by way of penalty clause, as well as the possibility of unilaterally terminating the contract to the detriment of the Customer. This clause falls within the scope of the provisions of article 1152 of the French Civil Code, which allows the judge to reduce the indemnity if the judge considers it excessive.

6.5. Reservation of ownership

IZOM Athlétique remains the owner of the Products sold until full payment of the price in accordance with this retention of title clause, without prejudice to the provisions of article L. 216-4 of the French Consumer Code.

VII. Order processing
7.1. How to order

The User may browse the Site without obligation to purchase.

To place an Order, the Customer selects the Product(s) of his/her choice on the Site and adds them to his/her virtual basket. Product availability is indicated on the Site, in the description of each item. When their order is complete, they can access their basket by clicking on the appropriate button.

It is not necessary to create a personal account on the Site in order to place an Order. However, IZOM Athlétique requires certain personal data from the Customer in order to process the Order.

If the Customer so wishes, he/she may create a personal account enabling him/her, in particular, to track the history of his/her Orders on the Site and to retrieve the corresponding confirmations and invoices. The creation of a personal account requires the Customer to provide certain personal data.

7.2. Order validation by the user

By consulting their basket, users will be able to check the number and nature of the Products they have chosen, and will be able to check their unit price, as well as their total price. They will be able to remove one or more Products from their basket. If they are satisfied with their order, they can validate it. They will then be taken to a form on which they can either enter their login details if they already have them, or register on the Site by completing the registration form.

The Customer is responsible for providing complete, up-to-date and accurate information, and IZOM Athlétique cannot be held liable in this respect. The Customer is informed that some of the information requested is mandatory for the proper execution of the Order placed, which he expressly acknowledges.

Product descriptions are available to the Customer on the Site, which the Customer accepts and acknowledges.

Once the Order has been finalized, IZOM Athlétique will confirm acceptance by sending an email to the Customer at the address indicated in the Order.

7.3. Payment by the Customer

Once they have fully completed the Order form, Customers will be invited to check or modify their delivery and invoicing details, and will then be invited to make their payment by being redirected to the secure payment interface marked “order with payment obligation” or similar.

The Order is validated once payment has been made in full and received by IZOM Athlétique.

7.4. Order confirmation by the publisher

Once payment has been received by the Publisher, the latter undertakes to acknowledge receipt to the Customer electronically, within a maximum period of 24 hours. Within the same time limit, the Publisher undertakes to send the Customer an e-mail summarizing the order and confirming that it has been processed.

IZOM Athlétique will send the Customer an invoice by email to the address given at the time of the Order. The Customer is advised to save or print the invoice and keep it.

IZOM Athlétique undertakes to honour validated Orders within the limits of available stocks.

7.5. Refusal/Cancellation of order

In the event of unavailability of one or more Products after the Order has been placed, the Customer will be notified by email.

The Customer will have the choice of being reimbursed the amount corresponding to the unavailable Products, or of being delivered when the Products concerned are once again in stock (unless they are permanently withdrawn from the catalog).

In any event, IZOM Athlétique shall not be liable for any loss suffered by the Customer, nor shall it be liable for any damages.

IZOM Athlétique may modify the range of products offered for sale on the Site at any time, without prejudice to Orders placed by the Customer.

Furthermore, IZOM Athlétique reserves the right to refuse any order for the following reasons:

The quantities of Products ordered are abnormally high for customers who are consumers;
A pre-existing dispute with the Customer;
Failure to pay in full or in part for a previous order by the Customer;
Refusal of payment authorization by banking institutions.
The Customer may cancel any order for Products, without giving any reason, provided it has not already been dispatched. The Customer shall send his request for cancellation in the “Contact” section of the Site.

VIII. Delivery
8.1. Delivery times and methods

Delivery charges will be specified on the Site, inclusive of all taxes, during the Order process and must be accepted by the Customer at the time of Order validation.

They will appear on a separate line from the price of the Products. It is expressly specified that the amount of delivery charges may vary according to the territory in which the Products are delivered, which the Customer expressly acknowledges and accepts.

Delivery times are indicated on the Site and depend on the delivery method chosen by the Customer. Delivery times exclude Saturdays, Sundays and public holidays. Pursuant to Article L. 216-1 of the French Consumer Code, the Parties agree that the Products will be delivered within the timeframe specified during the Product Order process and prior to the validation of said Order. Delivery times are also indicated in the e-mail.

Delivery times include the preparation and dispatch of the Order, as well as the time required to deliver the Products to the point of delivery (the Customer's postal address or delivery point). In the absence of any indication on the Site of a delivery time for the Products, IZOM Athlétique undertakes to deliver them within a maximum of 30 (thirty) days from the Order validation email sent to the Customer by IZOM Athlétique. In this case, the Products concerned will be delivered within the period indicated on the Site and reminded at the time of the Order.

However, as IZOM Athlétique uses external service providers (carriers, postal services, etc.) to deliver the Products, IZOM Athlétique is totally dependent on these third-party service providers. The delivery times indicated on the Site may therefore be affected by the service providers, without IZOM Athlétique being responsible for these delivery delays and the consequences that may result from them.

For Products that have been pre-ordered, the Customer is informed of the delivery time(s) after checking with IZOM Athlétique's suppliers and manufacturers for manufacturing lead times. In any event, the maximum delivery time for pre-ordered products will be six (6) months from the date of the pre-order. IZOM Athlétique shall not be held liable for any failure to deliver during this period.

8.2. Receipt of order - Conformity of products

When delivery is made against a signature, the latter is proof of correct receipt of the parcel. The transfer of risk and responsibility for the Products takes place on receipt of the Products by the Customer. From this date onwards, the Customer shall be solely and exclusively responsible for them, as well as for their use and any consequences that may arise therefrom. Consequently, the Customer undertakes to check, at the time of delivery, that the Order delivered is complete, compliant and has not been damaged. If this is not the case, the Customer undertakes to refuse to accept the Order and to sign any supporting documents. Any Order received against the Customer's signature shall be deemed to be compliant, complete and in perfect condition at the time of delivery.

In the event that delivery is impossible due to the Customer's fault, IZOM Athlétique reserves the right to apply additional delivery charges, the amount of which shall be determined by IZOM Athlétique. In the event of non-payment of these charges, IZOM Athlétique shall be entitled not to proceed with delivery. The resulting loss will also be borne by the Customer.

Except in special cases or when one or more Products are unavailable, the Products ordered will be delivered in a single shipment if the Customer has chosen a single method of delivery. However, IZOM Athlétique reserves the right to split the delivery subject to informing the Customer by e-mail at the address indicated.No additional shipping costs will be charged.

In the event of failure by IZOM Athlétique to deliver the Product on the agreed date or, failing that, no later than thirty (30) days after the conclusion of the contract, the Customer may instruct IZOM Athlétique in writing to make delivery within a reasonable additional period.

If IZOM Athlétique has not complied with this new deadline, the Customer may terminate the contract by registered letter with acknowledgement of receipt, or in writing on another durable medium, for any reason other than force majeure or the fault of the Customer.

The sums paid by the Customer will then be returned to him at the latest within fourteen (14) days following the date of termination of the contract, to the exclusion of any compensation or deduction.

8.3. Transfer of risk

The risk of loss or damage to the Products is transferred to the Customer at the time when he, or a third party designated by him, takes physical possession of the Products.

Products delivered to the Customer by a carrier selected by IZOM Athlétique travel at IZOM Athlétique's risk.

IX. Right of withdrawal
9.1. Notification to the seller

Pursuant to Articles L.221-5 et seq. of the French Consumer Code, the Customer has a period of 14 days from the date of delivery of the Order to return any new and unopened product, in its original packaging and in perfect condition (any damaged, incomplete or damaged product or any product whose packaging has deteriorated will not be taken back), to request a refund without having to justify the reasons or pay any penalties, with the exception of the shipping and return costs charged to the Customer. If this period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.

To exercise his right of withdrawal, the Buyer must send his decision to withdraw to the Seller by any unambiguous statement before the expiry of the withdrawal period, in particular :

9.2 Return of products subject to retraction

IZOM Athlétique will not reimburse cosmetic products whose lids have been removed.

The Customer must therefore place the intact packaging containing the product in suitable packaging to which the return label will be affixed, before sending it by post. The Customer must also enclose a copy of the invoice or any other element enabling the Order to be identified and its owner.

The Product is returned at the Customer's risk. If the package is lost, stolen or damaged when the Product is returned, IZOM Athlétique reserves the right to refuse reimbursement of the returned Product(s).

Only the Customer identified as such to IZOM Athlétique may exercise this right, to the exclusion of any other person, and in particular the person to whom the delivery was made. The return address is: 8 place Salvador Allende 94000 Créteil.

The Customer is reminded that he/she may be held liable for the depreciation of the Product(s) resulting from handling other than that necessary to establish the nature, characteristics and conformity of the Products to his/her expectations.

9.3. Refund of products subject to retraction

As soon as the return has been processed, the amount of the refund will be communicated to the Customer by e-mail and credited to the means of payment used for the initial transaction. With the Customer's agreement, another method of payment may be used. In any event, this refund will not incur any costs for the Customer. However, IZOM Athlétique is not obliged to reimburse the Customer for any additional costs if the Customer has expressly chosen a delivery method that is more expensive than the standard delivery method offered on the Site.

IZOM Athlétique will not take back :

Items returned incomplete, spoiled, damaged, opened or soiled by the customer; Items not returned intact with their labels in their original packaging;
Packages for which no element is attached to identify the sender (order number, surname, first name, address), elements that must be written on plain paper along with the returned product(s).
XI. Intellectual property
Without this list being exhaustive, the “IZOM Athlétique” brand and its derivatives and variations, logos, graphic charter, layout, information, presentation and content of the Site are the exclusive property of IZOM Athlétique. The systems, software, structures, infrastructures, databases and content of any kind (texts, images, visuals, music, logos, trademarks, databases, etc.) relating to the Site are also protected by all intellectual property rights or rights of producers of databases in force, of which IZOM Athlétique is the sole holder or owner of the rights. Any disassembly, decompilation, decryption, extraction, reuse, copying and, more generally, any act of reproduction, representation, distribution or use of any of these elements, in whole or in part, without the prior written authorization of IZOM Athlétique, is strictly prohibited and may result in legal action.Any reproduction or representation, in whole or in part, of the Site or its component parts, such as, but not limited to, trademarks, logos, graphics, layout, information, presentation and content, is prohibited.

Browsing the Site does not imply any transfer of intellectual property rights to the User. IZOM Athlétique grants the User the right to access and consult the Site only in accordance with the terms and conditions set out in these GTC.
